Privacy Policy of Tellen Maschinenbau GmbH & Co. KG

We appreciate your interest in our company and how we handle data. Data protection is a top priority for Tellen Maschinenbau GmbH & Co. KG. To that end, we provide detailed information here about the data we collect and how we handle it.

The processing of personal data—such as a data subject’s name, address, email address, or phone number—is always carried out in accordance with the General Data Protection Regulation (GDPR) and in compliance with applicable country-specific data protection regulations. Through this Privacy Policy, our company aims to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, this privacy policy informs data subjects of their rights.

Tellen Maschinenbau GmbH & Co. KG, as the data controller, has implemented numerous technical and organizational measures to ensure the most comprehensive possible protection of the personal data processed via this website. Nevertheless, internet-based data transmissions may generally have security vulnerabilities, so that absolute protection cannot be guaranteed. For this reason, any data subject is free to provide personal data to us via alternative means, such as by telephone.

Definitions

This Privacy Policy is based on the terminology used by the European legislative and regulatory bodies when enacting the General Data Protection Regulation (GDPR). Our Privacy Policy is intended to be easily readable and understandable for the general public as well as for our customers and business partners. To ensure this, we would like to explain the terminology used in advance.

In this privacy policy, we use the following terms, among others:

a) Personal data

Personal data refers to any information relating to an identified or identifiable natural person (hereinafter “data subject”). A natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

b) Data Subject

A data subject is any identified or identifiable natural person whose personal data is processed by the controller.

c) Processing

Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or any other form of making available, alignment or combination, restriction, erasure, or destruction.

d) Restriction of processing

Restriction of processing means the marking of stored personal data with the aim of limiting their future processing.

e) Profiling

Profiling is any form of automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s work performance, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

f) Pseudonymization

Pseudonymization is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.

g) Controller

A controller is the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

h) Processor

A processor is a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller.

i) Recipient

A recipient is a natural or legal person, public authority, agency, or other body to whom personal data is disclosed, regardless of whether or not that body is a third party. However, public authorities that may receive personal data in the course of a specific investigative mandate under Union law or the law of the Member States are not considered recipients.

j) Third Party

A third party is a natural or legal person, public authority, agency, or other body other than the data subject, the controller, the processor, and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data.

k) Consent

Consent is any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which the data subject, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Handling of Data at Tellen Maschinenbau GmbH & Co. KG

Storage of Access Data

For technical reasons, IP addresses are stored anonymously by our hosting provider for 60 days. These are not further processed or evaluated.

Use of Provided Personal Data

With the exception of the data listed below, our hosting provider does not store or analyze any further personal data when our website is accessed. We do not analyze the data stored in connection with visits to our website, nor do we have any interest in storing or analyzing such data.

Cookies

“Cookies” are small files stored on users’ computers. Various types of information can be stored within cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit to an online service. Cookies that are deleted after a user leaves an online service and closes their browser are referred to as temporary cookies, “session cookies,” or “transient cookies.” Such a cookie can, for example, store a login status. Cookies that remain stored even after the browser is closed are referred to as “permanent” or “persistent.” For example, the login status can be stored so that users can log in again after several days. Similarly, such a cookie can store users’ interests, which are used for audience measurement or marketing purposes. “Third-party cookies” are cookies from providers other than the controller operating the online service. (Otherwise, if they are only the controller’s own cookies, they are referred to as “first-party cookies.”)

We may use temporary and permanent cookies.

If users do not wish to have cookies stored on their computer, they are asked to disable the corresponding option in their browser’s settings. Stored cookies can be deleted in the browser’s settings. Disabling cookies may result in functional limitations. We do not use cookies for advertising or direct marketing purposes. The cookie consent form is used exclusively for technically necessary functions as well as for analytics or statistical services that we actually use.

Cookie Consent Form

To request consent on our website for the processing of your device information and personal data via cookies or other tracking technologies, we use the GDPR Cookie Compliance consent tool from WordPress, hereinafter referred to as the “cookie consent form.”

Using the Cookie Consent Tool, you have the option to consent to or refuse the processing of your device information and personal data via cookies or other tracking technologies for the purposes listed in the Cookie Consent Tool. Such processing purposes may include, for example, the integration of external elements, the integration of streaming content, statistical analysis, and audience measurement.

You can use the Cookie Consent Tool to grant or withhold your consent for all (non-technically necessary) processing purposes.

The legal basis for the processing is Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR, insofar as the processing serves to fulfill the legally prescribed obligations to provide evidence of consent. In all other cases, Art. 6(1)(f) GDPR is the applicable legal basis. Our legitimate interests in the processing lie in the storage of user settings and preferences regarding the use of cookies and the evaluation of consent rates.

Inquiries via Email or Phone

If you contact us via email or phone, your inquiry, including all personal data contained therein (name, email address, phone number, inquiry), will be stored and processed by us for the purpose of handling your request. We will not disclose this data without your consent.

The processing of this data is based on Article 6(1)(b) of the GDPR, provided that your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries directed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), provided that such consent was requested. Consent may be revoked at any time.

The data you send to us via contact requests will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular statutory retention periods—remain unaffected.

Inquiry via Contact Form

If you contact us via the contact form, your inquiry, including all personal data contained therein (name, email address, phone number if applicable, content of the inquiry), will be stored and processed by us for the purpose of handling your request. We will not disclose this data without your consent. We use our own form fields for the contact form. The data entered is sent to our general email address.

The processing of this data is based on Art. 6(1)(b) GDPR, provided your inquiry relates to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries directed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), provided that consent was requested; consent may be revoked at any time.

The data you send to us via contact inquiries will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been fully processed). Mandatory legal provisions—in particular statutory retention periods—remain unaffected.

Application via Contact Form

If you wish to apply to us via the contact form, your request, including all personal data contained therein (name, email address, content of the request), will be stored and processed by us for the purpose of handling your application. We will not disclose this data without your consent. We use our own form fields for the contact form. The data entered is sent to our email inbox for applications and careers.

The processing of this data is based on Art. 6(1)(b) GDPR, provided your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries directed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), provided that consent was requested; consent may be revoked at any time.

The data you send to us via the contact form or by email will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular statutory retention periods—remain unaffected.

Storage of Access, FTP, Error, and Mail Logs

Our hosting provider logs the web server access logs, which record which pages were accessed and when. They contain the following data: IP address, directory protection user, date, time, pages accessed, protocols, status code, browser, operating system, data volume, referrer, user agent, and hostname accessed.

The IP addresses are stored in an anonymized form. To do this, the last three digits are removed; for example, 127.0.0.1 becomes 127.0.0.*. IPv6 addresses are also anonymized. The anonymized IP addresses are retained for 60 days. Information regarding the directory protection user used is anonymized after one day.

Our website may contain links to other websites.

Personal Data of Data Subjects

As part of our business relationship, you must provide the personal data necessary for establishing and conducting a business relationship and fulfilling the associated contractual obligations, or for which we are legally required to collect such data. Without this data, we will generally have to refuse to conclude the contract or execute the order, or we will no longer be able to perform an existing contract and may have to terminate it. This data is not collected via our website but in writing.

Automated Decision-Making

We currently do not use automated decision-making pursuant to Article 22 of the GDPR. We do not engage in profiling within the meaning of Article 4(4) of the GDPR. We use Google Tag Manager to integrate and manage tools on our website.

Your Right to Object under Article 21 of the GDPR

Right to Object on a Case-by-Case Basis

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you that is carried out on the basis of Article 6(1)(e) GDPR (data processing in the public interest) or Article 6(1)(f) GDPR (data processing based on a balancing of interests); this also applies to profiling based on these provisions within the meaning of Article 4(4) of the GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims.

Right to object to data processing for direct marketing purposes

We do not process personal data for the purpose of direct marketing.

If you wish to object to the processing of your personal data by Tellen Maschinenbau GmbH & Co. KG, you may submit your objection in any form with the subject line “Objection,” stating your name and address, to us at:

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their workplace, or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract provided to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock icon in your browser bar.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Access, Deletion, and Correction

Within the scope of applicable legal provisions, you have the right at any time to request, free of charge, information about your stored personal data, its origin and recipients, and the purpose of data processing, or to request the deletion of this data. You may contact us at any time regarding this matter or any other questions about personal data.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. You may contact us at any time regarding this matter. The right to restriction of processing applies in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally require time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was or is unlawful, you may request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure.
  • If you have lodged an objection pursuant to Art. 21(1) of the GDPR, a balancing of your interests against ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, such data—apart from its storage—may only be processed with your consent or for the purpose of asserting, exercising, or defending legal claims, or to protect the rights of another natural or legal person, or for reasons of an important public interest of the European Union or a Member State.

Analytics Tools

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, store cookies, or perform independent analyses. It serves solely to manage and deploy the tools integrated through it. However, Google Tag Manager records your IP address, which may also be transferred to Google’s parent company in the United States.

The use of Google Tag Manager is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and straightforward integration and management of various tools on its website. If consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25 TDDDG, insofar as the consent covers the storage of cookies or access to information on the user’s device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent may be revoked at any time.

Google Analytics

This website uses features of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, time spent on the site, operating systems used, and the user’s origin. This data is associated with the user’s respective device. It is not linked to a user ID.

Furthermore, Google Analytics allows us to track your mouse and scroll movements and clicks, among other things. Google Analytics also uses various modeling approaches to supplement the collected data sets and employs machine learning technologies in data analysis.

Google Analytics uses technologies that enable user recognition for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google regarding the use of this website is generally transmitted to a Google server in the United States and stored there.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG. Consent may be revoked at any time.

Data transfer to the U.S. is based on the EU Commission’s Standard Contractual Clauses. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/.

The company is certified under the “EU-U.S. Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the United States designed to ensure compliance with European data protection standards for data processing in the United States. Every company certified under the DPF commits to adhering to these data protection standards. Further information on this is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

IP Anonymization

Google Analytics IP anonymization is enabled. This means that your IP address is truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before being transmitted to the United States. Only in exceptional cases is the full IP address transmitted to a Google server in the United States and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
